Employer obligations
D.P.R. 462/01 introduced greater obligations and responsibilities for the employer: it establishes the employer’s duty to request the periodic inspection of earthing installations, lightning protection installations and electrical installations in places with an explosion hazard (art. 4(1): “Il datore di lavoro è tenuto ad effettuare regolari manutenzioni dell'impianto, nonché a far sottoporre lo stesso a verifica periodica ”).
From the date of publication in the Official Gazette of MAP Directive 11/03/02, employers, both public and private, may also turn to Authorised Bodies, remaining responsible and subject to penalties for failure to inspect.
In substance, responsibility for failure to inspect is attributed to the employer, who must ensure that checks are carried out at the frequency required by law; delays attributable to public bodies are no longer a justification.
After a positive inspection outcome, the Authorised Body issues the related report to the employer, who must keep it and, on request, show it to the supervisory authorities (art. 4(3): “Il soggetto che ha eseguito la verifica periodica rilascia il relativo verbale al datore di lavoro che deve conservarlo ed esibirlo a richiesta degli organi di vigilanza”).
The employer is also the holder of the electricity supply contract for the electrical installation used by their employees and is responsible for keeping their electrical installation efficient and safe, and is consequently subject to D.P.R. 462/01.
In addition, under Legislative Decree 81/08 (Consolidated Law on health and safety at work) art. 80, the employer takes the measures necessary to safeguard workers from all electrical risks and, in particular, from those arising from: indirect electrical contacts (b), ignition of explosions (d) [paragraph 1] and prepares operating and maintenance procedures to ensure that the level of safety is maintained over time [paragraph 3].
The definition of Employer given by Legislative Decree 81/08 (art. 2, letter b) is reported below (original Italian text):
“ il soggetto titolare del rapporto di lavoro con il lavoratore o, comunque, il soggetto che, secondo il tipo e l’assetto dell’organizzazione nel cui ambito il lavoratore presta la propria attività, ha la responsabilità dell’organizzazione stessa o dell’unità produttiva in quanto esercita i poteri decisionali e di spesa.
Nelle pubbliche amministrazioni…, per datore di lavoro si intende il dirigente al quale spettano i poteri di gestione, ovvero il funzionario non avente qualifica dirigenziale, nei soli casi in cui quest’ultimo sia preposto ad un ufficio avente autonomia gestionale, individuato dall’organo di vertice delle singole amministrazioni tenendo conto dell’ubicazione e dell’ambito funzionale degli uffici nei quali viene svolta l’attività, e dotato di autonomi poteri decisionali e di spesa.
In caso di omessa individuazione, o di individuazione non conforme ai criteri sopra indicati, il datore di lavoro coincide con l’organo di vertice medesimo. ”
