Explosion hazard

Who must do what, and in which order:

The installer builds the installation and carries out the inspections required by standards and legal provisions on the installation itself, then issues to the employer the declaration of conformity under art. 7 of Ministerial Decree 37/08, completed according to the model in annex I or II. The declaration is dated and signed by the installer and by the technical manager of the firm that built the installation. In the case of electrical installations in places with an explosion hazard, issue of the declaration of conformity does not count as Homologation of the Installation.

After receiving the declaration of conformity the employer may PUT THE INSTALLATION INTO OPERATION, that is start the working activity.

Within thirty days of putting the installation into operation THE EMPLOYER SENDS TO THE TERRITORIALLY COMPETENT ISPESL AND ASL/ARPA (in municipalities where the One-stop Shop for productive activities has been activated, the two copies are sent to it, which forwards them to the competent parties) a copy of the declaration of conformity (without annexes) together with a transmission form describing the location, type and size of the installation. ISPESL issues a receipt of the declaration of conformity in order to document fulfilment of the obligation.

ASL/ARPA, within two years, carries out the first inspection of the installation (it does not coincide with the periodic inspection), which has the value of HOMOLOGATION. [Homologation is the administrative act attesting conformity of the installation considered with the state of the art and with the laws in force and refers only to first or new installations: if the installation is rebuilt even substantially, it is no longer homologation but an extraordinary inspection.]

The employer is required to carry out regular MAINTENANCE of the installations.

The employer is required to have the installations undergo PERIODIC INSPECTION. The inspection request, using a specific form, may be made to ASL/ARPA or to Authorised Bodies (authorised by MiMit). These inspections are at the employer’s expense. The inspection request must be:

Biennial in every case.

This inspection cannot be carried out by installers.

• Once the inspection has been carried out, the BODY issues a REPORT to the employer, who must keep it and produce it in the event of checks by the supervisory authorities and for subsequent inspections.
